This graduation thesis is about the Trademark protection for Citrocel in the EU. Citrocel, also know as “IB-International Ltd./Citroce”, is one of the investment of LLX2 Investment. LLX2 develops a protection strategy in the form of General Terms & Conditions and Distribution contract, since a new set of product will be launch into the new market by Citrocel. Regarding to this new business, how to protect their intellectual property right has become top priority for CITROCEL at this moment.
For the intellectual property protection, on one hand, EU at this moment does not have a common framework for the General Terms and Condition, on the other hand, the existing contract from LLX2 still need to be improved to adapt the new situation and business.
Knowing the meaning of intellectual property and Trademark become necessary when doing the research. By analyzing the current Trademark protection in the EU can know that it is not effective and comprehensive presently. While this research can give a general information about how to protect the trademark, this is why it important.
After the research based on General Terms and conditions and Distribution agreement, problems was found that the contracts is incompletely, therefore at the end of this research, new contracts were developed. This researching process includes contract comparison, legal reference and data analysis.
At the end there will suggestions for this research about the improvement of trademark protection for my client.
