The following report explores the impact of the 2023 Law governing Land and Waterways, in relation to the 2021 Law governing Public Transport Bus Services, on public transport bus services within Kigali, Rwanda. The study aimed to determine how the legislative changes empower the City of Kigali to assume the role of Contracting Authority in a Public-Private Partnership (PPP) initiative for public transport.
Through a qualitative analysis of the public transport and PPP legislation, this report assesses the legal and institutional shifts influenced by recent laws. Through the comparative analysis of the Gautrain and Transantiago PPPs, a benchmark is drawn for best practices in a PPP. The findings suggest that the new legal framework facilitates clearer role delineation, an objective presented by the drawn benchmark and encouraged by international principles.
The report concludes with a synopsis of the report’s findings and a process of elimination based on these findings, to determine the appropriate Contracting Authority. The insights found within this report contribute not only to academic discussions of PPPs in urban mobility but also provides a practical guide for future PPPs within Rwanda’s public transport system (should the project expand beyond its scope of Kigali).
